Please read these Terms of Service carefully before using Executify. By accessing or using our service, you agree to be bound by these terms.

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Executify website and services (collectively, the "Service") operated by Executify ("we", "us", or "our").

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

3. Service Description

Executify is a platform designed to help users build on ideas, validate ideas, and improve time management and execution speed. The Service is currently in development and available through a waitlist system.

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

4. Waitlist Registration

To join our waitlist, you must provide a valid email address. By joining the waitlist, you:

  • Agree to receive notifications about the Service
  • Confirm that the email address you provide is accurate and belongs to you
  • Understand that joining the waitlist does not guarantee access to the Service

You can unsubscribe from the waitlist at any time by contacting us at hi@executify.io.

5. User Accounts

Currently, the Service does not require or support user account creation. Access is provided through the waitlist system only. If user accounts become available in the future, additional terms will apply.

6. Pricing and Payment

Currently, the Service is free and available only through the waitlist. There are no paid plans at this stage. If paid plans are introduced in the future, pricing information will be provided separately, and additional payment terms will apply.

7. User Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Executify and is protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXECUTIFY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from unauthorized access to or alteration of your data

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim, or €100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Executify, its directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Augsburg, Germany.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms.
